{"id":5468,"date":"2019-03-06T15:58:52","date_gmt":"2019-03-06T18:58:52","guid":{"rendered":"http:\/\/sindicatopolicial.uy\/web\/?p=5468"},"modified":"2019-03-06T16:00:43","modified_gmt":"2019-03-06T19:00:43","slug":"nocturnidad-2","status":"publish","type":"post","link":"http:\/\/sindicatopolicial.uy\/web\/noticias\/nocturnidad-2\/","title":{"rendered":"Nocturnidad"},"content":{"rendered":"<p>Los funcionarios policiales y operadores penitenciarios comenzar\u00e1n a recibir una compensaci\u00f3n por nocturnidad. <strong>\u00bfCu\u00e1ndo se genera, c\u00f3mo se calcula y cu\u00e1ndo se paga?<\/strong><\/p>\n<p>La Ley de Rendici\u00f3n de Cuentas N\u00ba 19.670 del 15 de octubre de 2018, Art. 73 crea una partida con destino al pago de la compensaci\u00f3n por nocturnidad&nbsp;establecida por la&nbsp;<a href=\"https:\/\/www.impo.com.uy\/bases\/leyes\/19313-2015\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.impo.com.uy\/bases\/leyes\/19313-2015&amp;source=gmail&amp;ust=1551965571777000&amp;usg=AFQjCNGRW_dSs2EXq-Pue1zrXJX0BMr3bA\">Ley N\u00ba 19.313<\/a>&nbsp;de febrero de 2015, para los funcionarios de los&nbsp;escalafones L \u201cPersonal Policial\u201d y S \u201cPersonal Penitenciario\u201d, \u201cen las condiciones que&nbsp;establezca la reglamentaci\u00f3n\u201d.&nbsp;La citada ley 19.313 (reglamentada por el&nbsp;<a href=\"https:\/\/www.impo.com.uy\/bases\/decretos\/234-2015\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.impo.com.uy\/bases\/decretos\/234-2015&amp;source=gmail&amp;ust=1551965571777000&amp;usg=AFQjCNF2GVezNdxAMMjiBopqPoer5FAy0A\">Decreto 234\/015<\/a>), establece en su art\u00edculo 4\u00ba que \u201cLa sobretasa o compensaci\u00f3n horaria dispuesta en el art\u00edculo anterior, solo se aplicar\u00e1 toda vez que el trabajador desarrolle efectivamente las tareas en horario nocturno por m\u00e1s de cinco horas consecutivas por jornada de labor. A estos efectos se establece como trabajo nocturno todo aquel que se desempe\u00f1e entre las 22 horas y las 6 horas del d\u00eda siguiente\u2026\u201d&nbsp;A su vez, se establece una sobretasa o compensaci\u00f3n m\u00ednima del 20% para las distintas \u00e1reas de actividad o equivalente en reducci\u00f3n horaria.<\/p>\n<p><strong>\u00bfC\u00f3mo se genera el derecho a esa compensaci\u00f3n?<\/strong><\/p>\n<p>Los funcionarios de los escalafones referidos que desempe\u00f1an funciones en el Ministerio del Interior deben registrar su asistencia mediante su huella dactilar en el reloj biom\u00e9trico correspondiente, siendo de su responsabilidad y carga el registro correcto de&nbsp;su asistencia conforme a ese requisito de control, exceptuadas aquellas unidades operativas que a\u00fan no cuenten con ese tipo de dispositivos.&nbsp;La verificaci\u00f3n de las horas generadas como Nocturnidad ser\u00e1 realizada por la Gerencia del \u00c1rea de Gesti\u00f3n y Seguimiento Presupuestal, en coordinaci\u00f3n con la Gerencia del \u00c1rea de Gesti\u00f3n y Desarrollo Humano, a trav\u00e9s del sistema de informaci\u00f3n de los relojes biom\u00e9tricos.<\/p>\n<p><strong>\u00bfC\u00f3mo se calcula?<\/strong><\/p>\n<p>La periodicidad es mensual y se pagar\u00e1 la cantidad de horas realizadas entre las 22:00 y las 6:00, siempre que durante ese per\u00edodo se haya trabajado m\u00e1s de 5 horas consecutivas.&nbsp;La sobretasa del 20% se calcular\u00e1 sobre las siguientes partidas:<\/p>\n<p><strong>Escalaf\u00f3n L \u2013 Policial<\/strong><\/p>\n<p>Sueldo del grado&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 011.300<\/p>\n<p>B\u00e1sico Policial Integrado&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;021.300<br \/>\nAumento T\u00e9cnicos Salud&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;042.410<br \/>\nComp. al cargo Ejecutivo&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 042.412<br \/>\nAumento diferencial policial&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;042.411<br \/>\nCompensaci\u00f3n al cargo especial&nbsp; &nbsp; &nbsp; 042.520<br \/>\nEquiparaci\u00f3n b\u00e1sico de ASSE(*)&nbsp; &nbsp; &nbsp; 042.549<\/p>\n<p>(*) excepto los funcionarios que perciben la partida por nocturnidad del art\u00edculo 281 de la Ley 16.226 del 29\/10\/1991<\/p>\n<p><strong>Escalaf\u00f3n S \u2013 Penitenciario<\/strong><\/p>\n<p>Sueldo del grado&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;011.300<br \/>\nComp.
